10 Years Long Residence Eligibility

Hi everyone

I have a question regarding my 10 Years ILR Long Residence

i am due to apply for my 10 year Long Residence application but need some assurance beforehand

Profile

13 Jan 2017 Vignette Date (Tier 4 MSc Finance)

21 Jan 2017 Physical Entry

27th May 2018 (Went back to Pakistan before visa expiry)

29th May 2018 Visa Expired while I was in Pakistan

21 Nov 2018 (Tier 4 PHD) came back with new entry clearance

17th Feb 2021 (Switched to Skilled Worker)

21st Feb 2022 (Switched to Skilled Worker Dependant)

Currently on the same route (Skilled Worker Dependent Visa)

Can I apply for 10 year long residence ILR application on 22 Dec 2026

I am just confused about the time I spent in Pakistan without any valid visa between 29/05/17 till 20/10/17 (174 days in total).

I know my continuous residence is not broken but can I count these days during my 10 year legal residence calculation

Yes, it counts as acceptable absence from the UK

Your continuous residence is maintained but you will have to spend extra 174 days you spent outside UK without valid visa in addition to completing 10 years.

No they do not. That period is counted towards the allowable absences under the rules. Do not mislead the applicants
