Skilled Worker ILR eligibility – COVID concession (application vs grant date) and dependent eligibility

Hi everyone,
I’m seeking advice on my ILR eligibility under the Skilled Worker route, particularly regarding the COVID concession and switching from within the UK.
My situation (anonymised):
• Entered the UK in September 2017 on an ICT visa, valid until September 2022
• Switched to a Skilled Worker visa (same employer) from within the UK in mid-2021:
○ Application submitted: 23 June 2021
○ Visa issued: 18 August 2021
• Current Skilled Worker visa valid until 2027
• My spouse has been in the UK as my dependent since 2019, and switched to a Skilled Worker dependent visa at the same time as me

My questions:
1. COVID concession (application date vs visa grant date):
Can my qualifying period for ILR be counted from the application date (23 June 2021) instead of the visa issue date (18 August 2021), given that I applied from within the UK during COVID?
The caseworker guidance suggests this may be allowed:

However, I’d like to understand practical experiences — has anyone successfully applied based on the application date, or faced refusals?
Should I take a conservative approach and wait until July 2026 (based on visa issue date)?
2. Dependent (spouse) eligibility:
My spouse switched to a Skilled Worker dependent visa at the same time as me, but the caseworker guidance does not clearly mention dependents in this context.
Can she apply for ILR at the same time as me, or should we wait until July 2026 for her to complete 5 years?

ILR Application – Need Advice on Declaring Council Tax Summons

Hi everyone,

I am currently filling out my ILR application and wanted some advice regarding the “Convictions and other penalties” section.

After moving house in 2023, I forgot to set up my council tax direct debit. Around 5 months later, I received a council tax summons letter from Wokingham Borough Council/Magistrates’ Court regarding unpaid council tax. The letter stated:

“Complaint has today been laid by XXX Borough Council that you, being liable to pay Council Tax to the said authority have not paid the amount due as shown below. You are therefore summoned to appear before the court at the date and time shown. If you do not appear, you will be proceeded against as if you had appeared and dealt with in accordance with the law. If the court is satisfied that the amount is due, they will issue a liability order against you. This liability order gives the council considerable powers to recover the sum due by various means and will incur further costs.”

As soon as I received the letter, I immediately paid the full outstanding council tax amount along with the summons/admin costs. I also contacted the council afterwards, and they confirmed there is no outstanding liability or debt remaining against me.

I am planning to declare this in my ILR application under:
“A civil court judgment against you, for example for non-payment of debt…”

Below is the wording I am thinking of using in the application:

“What was the court judgment?”
Council tax summons proceedings for non-payment of council tax. The outstanding balance and summons costs were paid in full before the hearing date, and the matter was resolved before any liability order or further court action.

“Give more detail”
Council tax summons issued by Reading Magistrates’ Court in December 2023 due to missed council tax payments following a house move and failure to set up a new direct debit. The outstanding balance and summons costs were paid in full immediately upon receipt of the summons and before the hearing date. The council later confirmed that there was no outstanding liability or debt remaining.

Does this sound appropriate and factually correct for the ILR application?
Also, would this generally be considered an issue for ILR/good character requirements?

I would really appreciate guidance from anyone who has dealt with something similar.

You do not need to declare or explain this. It is a civil matter and you settled before court and liability order.

You do NOT have a Court Judgment.
