Main Applicant Getting ILR in 2026 – How Do Dependants Extend Until Eligible for ILR?

Post by kumar8080 » Mon Jun 15, 2026 10:59 am

I am the main Skilled Worker Visa holder (primary applicant). My Skilled Worker Visa started on 14 October 2021 and is currently valid until 14 November 2026.

Based on my understanding, I will complete five years in the Skilled Worker route in October 2026 and will be eligible to apply for Indefinite Leave to Remain (ILR). Assuming my ILR application is successful, I expect to obtain ILR around November 2026.

My family situation is as follows:

I am the main Skilled Worker Visa holder.
My spouse was granted a Skilled Worker dependant visa from 14 October 2021.
My first child was born in the UK and was granted dependant status.
My spouse and first child spent approximately 18 months in India and returned to the UK on 28 November 2023.
While we were in India, my second child was born in India.
My spouse, first child, and second child all entered the UK on 28 November 2023.

My understanding is that even if I obtain ILR in November 2026, my spouse and children may not yet qualify for ILR and may need to continue as my dependants until they complete the required qualifying period.

However, I am not sure whether the rules are different for my first child because she was born in the UK.

My questions are:

Assuming I successfully obtain ILR in November 2026, can my spouse and children extend their visas as dependants of a person who has settled status (ILR) until they become eligible for ILR themselves?
Since my spouse, first child, and second child have been living in the UK since 28 November 2023, would they need to remain on dependant visas until approximately 28 November 2028 before they can apply for ILR?
My first child was born in the UK. Once I obtain ILR, is there any route for her to be registered directly as a British citizen, or apply for British citizenship, instead of waiting to qualify for ILR first?
My second child was born in India and entered the UK on 28 November 2023. Would the ILR requirements for this child be different from those for my UK-born child?

If my spouse and children need visa extensions after I obtain ILR, are the following the correct GOV.UK routes and guidance?

Skilled Worker dependants guidance:
https://www.gov.uk/skilled-worker-visa/ ... d-children

Dependant partner extension application:
https://apply-to-visit-or-stay-in-the-u ... tner_in_uk

Dependant child extension application:
https://apply-to-visit-or-stay-in-the-u ... hild_in_uk

According to the Home Office guidance below, what length of visa extension should I request for my spouse and children after I obtain ILR? Can I request more than three years if they need additional time to qualify for ILR?

Home Office guidance:
https://assets.publishing.service.gov.u ... routes.pdf

When applying for their visa extensions after I have obtained ILR, do I need to provide my ILR approval details (eVisa/share code/reference number) as evidence of my settled status?

I would appreciate any guidance on whether my understanding is correct, particularly regarding my UK-born child and whether she may be eligible for British citizenship once I obtain ILR.

Thank you.
