Clarification on ILR for Child born abroad to parents holding ILR

Post by Nbsm » Tue Jun 23, 2026 11:17 am

Hi . I would like to clarify on possibility of applying Indefinite Leave for child due to be born in India . Me and my wife both have ILR . For delivery , my wife is planning to go India . I was told that they have an option to apply ILE (Indefinite leave to Enter) from India and not ILR, but i am unable to navigate to the write page as if i click on apply outside the UK , it says i need to follow a different route.
Could you please help clarify
1. Can we apply Indefinite leave for child born in India for parents holding ILR
2. Would there be any challenges?

Thanks

There is no form to apply for indefinite leave to enter from abroad.

You apply for a child settlement visa for 2.5 years. Often they are then granted indefinite Leave to Enter. You will have to pay the high visa fee and IHS and meet all the requirments.

If the child is born in the uk, the child will be British automatically and can apply directly for a British passport, which is substantially cheaper.

Thanks for the reply . Would that mean i will have to apply family visa to bring him to the UK (pay IHS and Visa Fee) and then apply again for ILR (Pay Fee) when he is in UK? Is there a requirement to meet the 5 year wait perioed as well? Was not aware of the 2.5year visa requirement. Could you please help clarify?

Thanks

Potentially yes but it is likely the child will be granted ILE, although it doesn't always happen when a applying for a child visa for 2.5 years.

You still have to pay the visa and IHS fees.

Your cheapest option would be for the child to be born in the uk.
