Need advice on the correct visa applications for my wife and children after receiving ILR

Post by senthilnathsr » Sat Jun 27, 2026 10:04 pm

Hi Team,

I received my Indefinite Leave to Remain (ILR) in June 2026 after being on a Skilled Worker visa.

My family's current status is:

Wife: Skilled Worker visa sponsored by her current employer (completed 2 years on this route), visa expires August 2026. Extending her Skilled Worker visa may be difficult after August.
Child 1: My dependant, not born in the UK, visa expires July 2026.
Child 2: My dependant, born in the UK, visa expires July 2026.

I would appreciate guidance on the following:
  • What is the correct visa route for my wife now that I have ILR? Should I apply for a Dependant Partner visa linked to my settled (ILR) status, or is there another application I should use?
Which application should I use for Child 1 to continue as my dependant now that I have ILR?
Can Child 2, who was born in the UK, apply directly for British citizenship using Form MN1, or do they first need to apply for another immigration status?
I've received conflicting advice, so I'd really appreciate guidance from anyone who has been through a similar situation or is familiar with the current UK immigration rules.

Thank you in advance!

You claimed in 2020 that you got ILR in 2015 and your wife was supposed to settle in 2020.
Now you are asking a totally different question for a totally different case ??

The spouse will extend under the current dependant route as normal. The fact that the husband has ILR is irrelevant. Do NOT switch them to the family route. The non-UK born child follows the same path as the spouse and settles with her.

The UK born child can be registered as British now using form MN1, without even needing a visa or ILR.

Hello Zimba,

Thanks for your response. I'm now clear about the route for my second child.

To clarify my situation regarding my wife and first child: my wife is not currently my dependant. She holds a Skilled Worker visa sponsored by her employer, but her employer has indicated that it is unlikely to be extended beyond August 2026.

Since I now have ILR, I am considering switching both my wife and my first child to become my dependants.

Could you please let me know if this is the correct approach? If so, which visa/application should I use for:

My wife
My first child

Thanks again in advance for your guidance.

Well, in this situation there is no other option. They will have to apply under family route using form FLR(M)
