Good afternoon, please I need serious immigration advice as I don’t know what to do again. I came into the country with my husband in November 2022 under the skilled worker health and care visa with SOC 6145 and have been with my spouse in the uk since then. Then I changed employer in December of 2023 and this was an NHS job so I was issued a new COS with SOC 6141 so I applied for a new visa which was granted but my spouse didn’t apply with me as he still had a year’s visa left on his prior entry visa, and as stated on the gov.uk website he wouldn’t need to apply with me and would only have to renew towards the end of his current visa. So because it was a fixed contract of 1year the COS given was for a year and the visa was for a year, so only I as the main applicant applied for a new visa.

Then before the 1 year visa expired my employer gave me a permanent contract of 3years with a COS for 3years with SOC 6135 in 2024 September, I immediately raised alarm with my employer stating that 6135 does not allow for dependents but my employer stated that the former code 6141 given to me doesn’t exist anymore and that the no dependents rule wouldn’t apply to I and my spouse as we have been in the UK since 2022 before the no dependent law was enacted on 11 March, 2024, so she asked me to go ahead and apply for my husband and I’s visa, we applied and my visa as the main applicant was approved within 48hours but my husband’s visa was denied stating that dependents are not allowed under code 6135.

This is where the nightmare began as my employer told me that that’s impossible and it must be an administrative error and I must quickly look for an immigration lawyer and apply for an administrative review, we were recommended to the worse immigration lawyer ever, who kept giving the wrong advise and digging a pit for us and now we don’t know if our case is irreversible but we need urgent help and advice.

In summary the AR took a year and was denied and by then I had a baby in 2025 and applied for a visa for her and it was also denied, then the lawyer advised that we apply for a section 120 and took all our documents and even asked us to send our international passports and my baby’s birth certificate, the section 120 application wasn’t upheld by the caseworker and all our documents were returned but the home office held on to my husband’s passport and my baby’s birth certificate. And has been sending him a reporting since the AR was denied because they put him on immigration bail, the lawyer explained what immigration bail was to us and said it was home office giving my spouse a chance to make a fresh application but we’ve just found out that explanation was false.

The lawyer then blamed my employer for the entire mishaps and advised that I should go back to my employer and make a request for a new cos with code 6131 of which I did and was given immediately by employer but this was after 14days window, we then made a fresh skilled worker dependent application for both my husband and baby and myself in December 2025 due to the change of SOC code and my visa was granted within 48hrs but my husband and baby had to go for a physical biometrics on 31st of December 2025, because they had no identity documents to apply online. After the biometrics we’ve been waiting for more than 6months for the visa decision and in that time since my husband was in immigration bail, he was not allowed to work and I was on maternity leave throughout this battle and after sending a complaint in to the home office about why the visa was taking too long, this morning at about 7am the decisions for the visa came and they were both refused stay.

And my husband was tagged an overstayer. Please I need urgent advise I don’t know what to do, we didn’t even know he was overstaying because the lawyer gave us a completely different explanation on what immigration bail is.
