My Current Status:

I currently hold Pre-Settled Status, which has been extended by the Home Office until November 2030.

I am currently employed and based in London.

Marriage and Divorce Timeline:

Marriage started: September 1, 2020.

Divorce finalized: January 2024.

The Complication: While the marriage technically lasted over 3 years on paper before the final decree was issued, the actual divorce proceedings were initiated before our 3-year anniversary.

My Questions:

Retained Right of Residence (RRR): Given that the Home Office usually looks at the date proceedings were instituted rather than the final decree, does this timeline completely kill my chances of applying for Settled Status via RRR? Is there any precedent or exception for this under Appendix EU?

Alternative Routes: If EUSS is a dead end for me, what are my best practical alternatives? I am looking into switching to a Skilled Worker Visa (though my current job does not sponsor) or working toward the 10-year Long Residence route. Has anyone successfully transitioned from Pre-Settled to another route in a similar situation?

Here are the key facts of my situation:

My Immigration Status:

Pre-Settled Status Granted: 30 November 2020.

Current Status: Automatically extended by the Home Office (valid until November 2030).

Settled Status Deadline: I know I must manually apply for Settled Status, as I won't get an automatic upgrade.

The Marriage and Divorce Timeline:

Marriage Date: 1 September 2020.

Divorce Issued by Court (Initiation): 22 May 2023.

Conditional Order: 7 December 2023.

Final Order: 22 January 2024.

Co-habitation: Both my ex-partner (EEA national) and I lived continuously in the UK.


The Issues I'm Facing:

The 3-Year Rule: The Home Office requires the marriage to have lasted 3 years prior to the initiation of divorce proceedings. Based on the Court Issue Date (22 May 2023), my marriage legally lasted 2 years, 8 months, and 21 days before initiation. I missed the 3-year mark by just over 3 months.

Question: Is there any caseworker discretion applied here? Do they ever consider the Final Order date instead of the Issue date? Or is this a strict, hard refusal?

Alternative Pathways: If RRR is unavailable, what are the most viable strategies for transitioning out of Pre-Settled Status (such as shifting to alternative visa routes or pursuing the 10-year Long Residence path)?
