I would really appreciate some guidance regarding my situation.
I am currently in the UK and have an in-country appeal pending before the First-tier Tribunal following the refusal of my EU Settlement Scheme (EUSS) application.
Recently, I have been offered a position with a Home Office licensed sponsor. The role is Highly Skilled eligible under the Skilled Worker route, and the proposed salary is between £41,700 and £52,600, meeting the Skilled Worker salary requirements.
The employer has already completed a right to work check using my Home Office share code and confirmed that I currently have the right to work in any job. My UKVI online account also shows that my right to work remains valid.
My understanding is that if I submit a new Skilled Worker application from inside the UK, my pending EUSS appeal would automatically be treated as abandoned. As a result, I assume my current EUSS-related right to work would also come to an end.
My main concern is this:
If I submit a Skilled Worker application from within the UK and my EUSS appeal is automatically abandoned, how significant is the risk if the Home Office later refuses the Skilled Worker application?
In that situation:
Would I immediately lose my right to work because the EUSS appeal had ended?
Would I be left without any immigration status or permission to work while challenging the Skilled Worker refusal?
Has anyone experienced or advised on a similar situation?
Finally, if this risk is considered significant, what would be the recommended or safest next step in my circumstances? Would you advise waiting until the EUSS appeal is concluded before applying, or is there another route or strategy that would better protect my immigration status and right to work?
I appear to meet all the Skilled Worker requirements, including sponsorship, the appropriate occupation code, English language requirement, and the relevant salary threshold. My concern is not whether I qualify for the Skilled Worker route itself, but rather the legal implications of abandoning my EUSS appeal and the consequences if the Skilled Worker application were unexpectedly refused.
I would be very grateful for any advice, relevant Home Office guidance, Immigration Rules, or personal experiences.
