Post by aj77 » Sun Jun 12, 2005 10:05 pm

I am in UK from last one and a half year.I got my Extension in Dec 2004 with the letter stating that I can apply for Indefinite Leave to Remain after completion of 4 years on appropriate form.I got the Job according my skills now and have good Salary and Bank balance.I just want to know that whether HSMP Visa holder can sponsor his parents or not?

Additionally I am a Director of a company too.Can I sponsor on behalf of my company?

No to both questions as per the immigration rules. However an application for your parents may be considered exceptionally outside the rules under the most compelling of circumstances - check posts by NDA for relevant criteria.

Yes you may act as a sponsor for subsistence and accomodation matters. Such would require a letter to this effect along with original or certified (by a notary or lawyer):

1. Bank statements.
2. Mortagage deeds/ tenancy agreements.
3. Utility bills to confirm residence.
4. Biodata page of your ppt.
5. HSMP EC/LTR visa page in ppt.
6. Letter from employer detailing position, length of assignment (permanent ect) and salary.
7. Relevant proof of relationship - birth certs/ sworn affidavits.

Details (esp 7) to be cross referenced with VAF 1 form where HSMP EC held. Notwithstanding submission of said documents your parents must satisfy the ECO they are bona fide visitors who will leave the UK i.e. they do not intend to make it their home. Especially an issue where long term visitor status requested e.g. 2 yrs and applicant travels back and forth as prescribed by 6 months max duration of stay for each entry with minimal exits from UK - beware that visa can and will be cancelled.

Good luck
