Query: options after leave to remain rejected

Post by hsmp28122006 » Tue Jan 27, 2009 9:50 pm

I am in UK on HSMP Visa which is going to expire in first week of Feb'09.
While filing the application this month, I had made a mistake in application form and in worst case my visa is going to be rejected.
I understand that I would provided around 28 days to leave the UK and will also have right to appeal.

My questions are:

1) Am I eligible to work after my visa is rejected and while appeal is in progress?
2) How much time would I be given to leave the country in case appeal decision is not favourable?
3) Can I apply for tier-1 entry clearance as soon as I go out of the UK back to my country of birth?
4) How is it going to affect my ILR in case I have to leave the country and come back to the UK after entry clearance is approved? Would my initial 2 years not be counted while applying for ILR?

Thank you very much for your support!

Hi,

This is what i have seen...still would seek advice from others..

1) Am I eligible to work after my visa is rejected and while appeal is in progress?

Yes.

2) How much time would I be given to leave the country in case appeal decision is not favourable?

28 Days from the date of rejection.

3) Can I apply for tier-1 entry clearance as soon as I go out of the UK back to my country of birth?

Yes.. only if you are not banned under Paragraph 320.

4) How is it going to affect my ILR in case I have to leave the country and come back to the UK after entry clearance is approved? Would my initial 2 years not be counted while applying for ILR?

The ILR counter will reset.. (i have read in forums but not sure)

All the best.. but can i ask why do you think your application will reject?
