I just got my passport renewed and my old passport has a US visa.

Now should I submit both the passports for Tier 1 application or just the latest one?. Please advice.

Also, for maintenance funds I am submittig3 bank statements covering pewriod form Nov 08 to Jan 09. 2 of these statements would be more than 1 month old. Will this be a problem since the evidence for maintenance funds cannot be more then 1 month old. Please let me know.

The criteria states that you ought to submit any passport that you used to enter or remain in the United Kingdom. Therefore your second passport is the more important one, though your first passport should probably also be submitted (in my opinion) to avoid any confusion regarding immigration history.

With regards to maintenance funds, only the last statement needs to be dated within a month of an application. Otherwise it would be very difficult to meet those criteria unless the bank issued a three month statement, or unless you asked the bank to reissue the statements. I personally wouldn't expect any problems with the way you hope to submit them.
