My age is 32 years old, I am married with 1 kid, I am an Indian, working in Middle east as a Computer Engineer (System Engineer).
I had applied for ACS in April 2007 and have been classified as Systems Manager (ASCO: 2231-11).
On November 21st 2007 i had applied for VISA via paper procedure (not online) through the Migration Agent, for the subclass 176 (skilled sponsored Visa, as my family members are in Melbourne).
On Feb 16th 2008 i had submitted IELTS result to the agent. i have scored IELTS overall 6.0 ( Reading 6.0, Speaking 6.0, Listening 6.5, writing 6.5).
From then till January 2009 my application was in processing and waiting for case officer to allocate.
In my own interest i have collected Police clearance Certificate for me and my family, at the same time i also have done Medicals in own interest.
On February 2009, my agent emailed me, said that the rules of processing visa application has been changed, so due to that i have to select the below mentioned options .
Option 1)
- Apply for State Sponsorship with any State Government in Australia and switch over
Your application to State Sponsored Migration which offcourse will be given priority as
per the current migration law amendment.
- You will have to pay a new visa Fee again (AUD$2010), when you re-active your visa
application under the State Sponsorship.
- We have to withdraw your current application in order to switcher over your application
from relative sponsorship to State Sponsorship. Since we got all the documents on
file, you do not need to supply any further documents other than any specific
documents requested by the State Government.
Option 2)
- Withdraw your current visa application and re-lode it again under the same visa class as
176 – relative sponsored but Electronic systems (ONLINE) Facility(You will have facility
where you can track your application online) – You have to pay the Visa Fee again
- This will make sure you that there will be NO issues with regards to your IELTS Test as
you have lodged your visa application prior to undertaking your IELTS in your earlier
Application.
- The only disadvantage here is that there may delay on the processing until DIAC finalise
all priority based applications.

You have a number of issues in the above post, first one is why did your agent allow you to lodge the application without IELTS?

It's a "time of application" criteria for the 175 and 176 visas, and the only exemption for main applicants I am aware of covers holders of passports from a few English speaking countries, (such as Britain and New Zealand).
