Tier 1 Application Query

Hi,

I am currently in UK with a WHM visa which expires in August. I have over the past 11 months earned £10000. With regards to my points, I need the band of £23000 to make my total points, so I am £13000 short. However, over this period of last one year, while I am in UK, I have had a business in India which is employee run and that business has generated an income of around £15000 and will have income tax returns filed up at the end of tax year for this amount.

My question is, will I be able to use this income in India as an addition and make the points up this way? Or since I am not in India physically my points wont be counted?

I understand I have to go to India to apply fo Tier 1, but how long does this process take from India, since I need to take time off from my present employment?

Is there an appeal process if my application fails initially?

Any help will be very much appreciated.
