Is it Necessary to be Married for Two Years ?

Post by majic » Fri Jul 01, 2005 5:35 am

A friend of mine got married last year i.e. 2004 in August. He is a Professional and wants to apply for HSMP.

Now the question that he has is; Whether he can apply for HSMP proving the relationship validity for one year or do you have to be married for atleast 2 years to apply for HSMP ?

Question # 1: Now if he is not claiming points for his wife/married partner. Can he apply proving only 1 year of relationship & not claiming points?

Question # 2: Can he apply proving only 1 year of relationship & claiming points for his married partner?

My guess is that it is good to provide evidences for 2 years but the condition is more vaild for Unmarried partners because that dont have a legal documents (i.e. Marriage Contract) to prove this.

Dear majic,

There is a simple criterion for claiming points for skilled partner and that is to show that you were living together (reagrdless married or unmarried) for at least last two years. SO in case of your frined, if he wants to claim points for his wife, he must show that they were both staying at the same address for last at elast two years, otherwise, he can simply apply on his own and acn not claim any point for his wife.

He can of course take her alongwith him when he goes to UK.
