When is it right to apply for PR ?

My wife is French by nationality.I am a non-EU citizen .We got married in November 2004 and were both granted residence permit for 5 years in June 2006.The residence permit was delayed for some reasons.
My five years residence permit will expire in july 2011.Me and my spouse live together and are both in full-time employment.
I want an advice on the best time(month pricisely), prior to July in 2011,to apply for my PR.Thanks :) :)

Can you explain more please. When did you actually move to the UK and start exercising EU Treaty Rights? Or were you in the UK prior to the marriage, on a student visa or whatever, and then got married?

Or if you came here on an EEA Family Permit, when did you enter the UK using that permit?

Thanks for the reply John.I actually started residing in UK in January 2004.My wife started exercising her treaty rights in May 2004 and i started working August 2006.

So what were you doing between January 2004 and August 2006? What was your UK immigration status?

John I don't think this is relevant. They were both married in Nov 04 and the wife has exercised treaty rights up till now. The OP attaining PR is based on his marriage and his wife being a 'qualified person'. This and not solely his own economic activities count towards PR.

As you both have been married since Nov. 04 and your wife has exercised treaty rights continuously from May 04, i'd say that you automatically attain permanent residency in Nov. 09.

By the way, why was your residence card delayed?

Thanks Plum for your response on this.I do believe my status(according to John) prior to getting my 5 yrs residence permit is irrelevant here.That question is for the HO to ask.The bottom line is i have got the residence permit .I only wanted someone here to advice me if it's ok to apply for my PR few months (probably 3 to 6 mths) to the expiration of 5yrs residence permit in July 2011.
