tier 1 visa with spent traffic conviction (drunk-driving)

Post by avibenshi » Thu Mar 05, 2009 6:21 pm

Hi,
I intend to apply for a tier 1 general skilled visa. I have a recent conviction in drunk-driving that resulted in a sentence of 5 months license disqualification. (this is considered a light sentence in my country as the quantity found was minor and i have a cleear previous traffic record). I read this post: http://www.immigrationboards.com/viewto ... 569#156569 and also the information here: http://www.bia.homeoffice.gov.uk/britis ... character/

I want to make sure I understood correctly. does this mean once my 5 months license disqulification ends I can apply to the tier 1 visa without mentioning the offence? (as by then according to the above arrticle it will be spent)?

What I understand that even if your declare this offence, it would not jeoprodise your Tier 1 application but it might, if you dont declare it. Just declare it and write at the end that it has been spent.
Thinking low is crime....

I had similar offence 5 years back.. I declared it and my tier 1 was approved.. I have seen a case in the forum where T1 was rejected as the offence was not declared.. jo just declare it..

Unfortunatley you are in the UK where this is considered a major offense. Even 2 times over the legal limit is serious enough. You must declare it, or else if your found out it will be an instant refusal.

Thanks for the answers, What im trying to understand is wheather I should wait untill the offence is spent before I apply or can I go ahead and apply now. what effect will it have on my application in either case.
