Doubt in filling section 3A of Tier 1 application form

Questions G1 and G2 says
G1) Does the applicant consider him/herself to be covered by the HSMP Forum Ltd. Judicial Review Judgment of 8 April 2008?
G2) Does the applicant wish to have the application assessed in accordance with paragraph 39-42 of the HSMP Forum Ltd. Judicial Review: Policy Document?

I am a Work Permit holder switching to Tier 1 status.
So in my case what should be the answers for these questions?

You should answer "No" to both, assuming that you were not on a HSMP visa prior to that date...
