Maintenance Funds Dependent

Hi

I have been living in the UK for a total of 3 years. For the first two and half years, I stayed on a work permit sponsored by my employer. In Jun 08, I changed my permit to tier one highly skilled immigration type.

I want to apply for my wife s dependent visa in March 09, who is currently based in Pakistan. As per the guidelines for dependent visa, the amount of maintenence funds should be 800 (for me) and 533 (for my wife) = 1333 £ (as I have been living for more than 12 months in the UK). I just wanted to confirm if this is the right amount or the right amount is 800 + 1600 = 2400 (I ask this because "my tier one work permit" is only 6 months old)?

Any help shall be highly appreciated.

All she needs is £533
If the main applicant has been present in the United Kingdom for 12 months or more, the main applicant or the family member of the highly skilled worker must have £533 to support himself/herself.
The guidance note does not specify that the main applicant should only be be under Tier-1 for atleast 12 months in order to qualify for above.

hi push_hsmp,

are you sure it is £533 only ? (and not £1333)

in the guidelines ,

point 31
in addition to £800 required for his/her own support
& point 32
(£533 x 3 = £1599 + £800)
state £800 must be shown for the main application as well (irrespective of whether the main applicant is in UK for less than 12 months or not)

I have attached 2emails i have received from BHC chennai below:

I)
Thank you for your e-mail. Dependants under Tier One and HSMP transition: must provide evidence of £1600 over the 3-month period. However, we will accept accounts in the name of the dependant and spouse (joint names), the dependant only, or the spouse only, to establish the £1600, providing the £1600 is in addition to funds already shown for the main applicant. It is advisable not to show the same £2800 shown for the principal applicant.

This clearly states that the main applicant also needs to show funds for the main applicant too according to how long you have been in the UK

ALSO read this under policy guidance: under Maintenance Requirement -page 7


29. If the Tier 1 migrant is outside the United .
Kingdom or has been present in the United
Kingdom for less than 12 months, each family
member of the Tier 1 migrant must show that
he/she, the Tier 1 migrant, or (for children) his/
her other parent who is also legally present
in the United Kingdom has at least £1600 to
support him/her; this is in addition to any funds
the Tier 1 migrant needs to prove he/she has
enough money to support himself/herself.

Got a reply from VFS after mailing them who told..

you need to show 1600 £ only per dependant.. i dont understand why you want to show mantainance funds for urself when u already have got ur hsmp visa and working in UK.. was the statement they made.

this message is to all those people who are pointing that the main applicant being in uk and working on tier1 hsmp has to show 800 £ which is not true..

With regard to your query,

Yes, you are right, you will not required to show any funds. As long as you are able to show satisfactory proof for source of funds and has also maintained it in your account (Personal/Current) for three months, you will be able to meet the maintenance criteria.

However, the discretion is with you.
