Guys pls i need ur advice about psw rejection

first of all i would like to thnx u all in advance. and i want to share my problem with u pls give me a good advice. actually i got refused my psw in jan09 with a right of appeal. i appealed and then i adjourned my case. i also engaged a solicitor in my case. now he is saying that we should withdraw the case and apply for student visa while on the other hand my visa is expired in oct08. i m just in a big confusion now if i withdraw my case from AIT and apply for student visa, is there any chance to get a student visa. pls share ur good advice. thnx again to all

Could you please tell us in a bit more detail. On which grounds HO refused your orignal application? and when you appealed why you adjourned? Technically you can only apply student visa from your own country. Once the visa is expired either you'll have to wait for the appeal outcome if the appeal result come against you then you have to go back to your own country and then apply from there.

Why your lawyer is saying to you to withdraw your appeal from AIT? Could you please give us a more in depth detail of your case! until then nobody can give you the right advice.
