im on discretionary leave till june 2006,came to uk in 2001 ,G/f(now wife) pregnant ,Arun born2002 ,married in july 2002, FLR applied in aug2002.After long stress(MP etc)wait DL granted in june 2004 for 2 yrs,meanwhile Meera born 2003,Ihave stepson 11 yrs old.Now marriage over ,divorce looming .please tell me if there is a way i can apply FLR in 2006 on grounds of being natural father of 2 brit citizens.All your kind help appreciated.God bless

hi again ,just to clarify a bit ,i came to uk on visit visa in ,when g/f got pregnant i panicked and overstayed 2 months before getting married hence the long wait for D/Leave which ends june 2006.the letter fron HO said that ill need to FLR in2006 and decision will be taken in light of info prevailing at that time...Please help a very distressed person .Thanx in advance

You cannot do that in the way you suggest.

But if you drop your AS status you can have access to your childers (Access to a Child).

You must be able to accommodate yourself without recourse to public funds.

You will be issued a 1 year EC in tha above capacity.

After 12 months in the capacity of a person having access to a child you can appy for ILR.

Somewhat personal but on what grounds is the marriage failing? The immigration rules allow for an ILR application where a relationship has failed on various grounds. Feel free to pm if you prefer. I may respond on the forum in a generic manner after such.

Based on your pm details I regret that I note no grounds where ILR may be applied for in the ILR exceptions I mentioned before. One would have to consider a different category of the rules or an application outside the rules.
