Hi,

My wife has been on her holiday for about 3 months now.

We will apply for ILR soon under the workpermit category. But there is question about whether you have stayed abroad for more than 3 months.

Does anyone know whether this could potentially effect our ILR application (or rather my wife's as a dependent ) i.e. she has not stayed in this country (even as a dependent) for the required duration??

So you are earning all the money and she is busy spending it - good girl :lol:

The settlement application Form SET (O) asks for the main applicant's absences from the UK not those of dependents included in the form e.g. spouses and/or children. However your wife must be in the UK when the appplication is submitted as evidence by the inclusion of her valid passport. Her absences though will impact on any future applications for naturalisation as a British Citizen.
