UK National but Wife is on a European Union Family Permit

Hi,

I need some advice on the following.

I am a UK National (Scottish) and have been married to my wife since October 2008. We also have a son who was born in the UK in December 2008.

My wife has a European Union Family Permit through her mum who is Colombian but has a Spanish passport. The visa runs out in May 2009 and she has been told that she has to go back to Colombia.

I am looking to see how she gets a visa as a spouse/wife.

Any information or guidance would be greatly appreciated.

Your wife would need to return to Colombia to apply for a UK spousal visa.

Alternatively, if you have been exercising treaty rights in another EU member state prior tp taking up residence in the UK, then she can apply in-country for a UK residence card (EEA2) using the Surinder Singh ruling.

Does anyone know how long the spouse visa could take as we have a 3 month old baby and this would be a lot for him. Is there no way we can apply from the uk. We spoke to an immigration lawyer today and he thought we could apply from the uk and not from colombia. Did he miss something. Im worried now.

Hi Good people

I know some us us are struggling with finances and some can't even get a job until they get a decision with their passports from the HO. Therefore, it is EXPENSIVE calling those 0870/0845xxxxxxxxx numbers that the Home office generally provides.
Don't give up, now you can call Home Office for free, just check out www.saynoto0870.com and you will be provided with a local 0208/0151/0161xxxxxx number where you can contact HO for FREE! The actual number is 01516725626. (But log on to www.saynoto0870.com and confirm for yourself)
Especially if you have a pay monthly home or mobile telephone contract. You can still call from a pay as you go mobile but the charge rate will be like you are calling your neighbour next door on any 0208xxxxxxxx number.
