ECO rejected Tier 1 General frm VFS Bangalore --help needed

Dear gurus,

I had applied for tier 1 general on july 2008 from Chennai BDHC thru VFS Bangalore and i have recieved the refusal letter on 24-03-09. It was a very long wait and a gruelling one but still unsatisfactory in the end. The application has been refused under the Previous earnings category.
The break up is as follows:

Points claimed Points awarded

Age 5 5


Qualification 35 35


Previous Earning 40 0


ECO comment is that : we have attemperd and have been unable to verify the documents supplied with the application using standard procedures. the documents we have been unable to verify are your payslips and company letter relating to you earnings.

In relation to the above following checks using the standard procedures i am strongly led to consider that u have not faithfully presented the employment at XXXX company Ltd.

dear gurus,

what are the standard procedures followed by the BHO. I had submitted my offer letter starting my salry and the salary slops i have submitted
are signed by my HR Admin manager too.

how do i explain this if they have already refused my application. my bank statement also clearly shows the salary deposited from my company.

Where do you gurus think the mistake has been made by the ECO in assessing my application . Please help gurus.

They must have tried to contact your employer and might not have got a satisfactory response. Do you know if anyone from BHC called your employer?

What supporting documets did you supply?

Hi guru,

I contacted my HR dept and they told me that around 3 months back they had got a questionnaire regarding my details and this has been sent back to the embassy after being filled up by the HR person , he informed me that he had given a positive response in the questionnaire regarding me.

Regarding the documents i sent,

1) Employment certificate
2)Salary slips
3)bank statements showing the salary deposited into my account from the company account.

The ECO in his comments (please read comments in 1st post) also mentions "As additional verifiable evidence was not supplied with your application, no points have been awarded in this area" i.e. under previous earnings.

What additional verifiable evidence do I have to give are the above three not enough?

Dear gurus there is a very small difference in the salary mentioned in the salary slips and the employment certificate, this is due to the project allowance or daily allowance which is added in the salary every month.
Every month the salary will fluctuate due to the addition of the allowances
and the exact salary amount that has been mentioned in the employment certificate has never been deposited in the bank account.

Is it this difference in the salary seen in the employment certificate and the monthly salary slips that have led the ECO to refuse my application.

If your salary slips were in order (per requirement specified in Guidance notes) and the amount credited to bank statements corroborated the net salary paid then the only thing that remains doubtful is verification with your employer. It would have been good if you knew what exactly resulted in the rejection. Can you please post the BHC letter verbatim?

Assuming that it was the verification that caused the problem, please get your employer to write a letter that they confirm details of your employment and that they responded to BHC queries satisfactorily and also that they will be willing to be contacted again if need be. You can supply this letter to BHC for your admin review (citing that this is not a fresh evidence but a mere re-statement of what has already been provided to BHAC as part of application process).

Please post your rejection letter verbatim so that we can try and guess the reasons behind rejection.

It is your mistake . HO IS CORRECT IN REJECTING YOU ....

Your post is a bit confusing -

1> You said in first post that you had submitted offer letter and payslips and in second post you have mentioned employment certificate and payslips. Are they both same?

2> Is your daily/project allowance is shown as a separate heading in payslip? Did you explained this difference between offer letter and payslip in cover letter?

3> Did you get a verbal reply or a reply thorugh email from your HR that they were contacted and had verified your employment? You can submit a printout of the email in Admin Review?

Hi Neo,

Quite unfortunate that you were refused. I believe you should go for a review. Write a very comprehensive letter in your review stating all the corroborating evidences provided such as payslip, Bank Statement,Letter of Employment is the same as the Certificate of Employment and clearly state any two corroborating documents that shows how much your employer pays as net salary into your bank. You must be very polite with your wordings in this letter because you are at their mercy as a result of your oversight. Also, if you can get your employer to give you a letter confirming your start date and end date with them, that will be of great value. You can request your employer to also write a letter to the Entry Clearance Manager, BHC stating that you worked with them including dates. They can also make reference to the earlier questionaire sent to the BHC. I believe this may work in your favour. I think you have the grace of 28 days from the date on the decision letter to file in your admin review. So be quick about this.

Dear Gurus,

Thanks for the replies.

The refusal letter was sent to me, along with that my passport was also sent. i am applying for Admin Review,

my questions

1) When i submit the review do i courier the passport along with it.

2)The space provided in the admin review form is very less to explain , can i add some additional sheets to the form which carry the explanation.
