old FLR form submitted after 6th April 2009

old FLR form submitted after 6th April 2009

Hi,

I had applied for the extension on 6th April using the old form as I was not aware of the changes.

I have received the reference number from UKBA as they have deducted the payment of 750 pounds on 7th April.

On UKBA site under Tier 1 section its mentioned that under immigration rule 34I old forms will be valid for 21 days after any changes but still is there any chances of it getting rejected later because of wrong form and fees? In case it can be rejected can I do something from my end to avoid that as my current visa is expiring in 4 weeks time.

The best course of action for you would be to contact UKBA immediately and send them your application in "new" form citing the reference number. I hope they have deducted the correct fee amount (its GBP 750 for Nationals of countries that have ratified the 1961 Council of Europe Social Charter & £820 for others). If this is not the case then you are in trouble. You will then have to withdraw your application and resubmit using a new form, I think.

Hi,

Thanks for the advice. I'm indeed trying to contact UKBA to know what they are doing with it.

They have taken the old fee, I'm an Indian citizen and as per new system the fee will be 920 pounds(Main + 2 Dependents). I can't file the new form because all the originals are submitted with the current applications. My initial approval was on May 2005 and in May 2006 I got mine 3 year extension, so although as per the latest decision I'm eligible for ILR but don't know when that will be implemented.

I just hope that I don't lose my 750 pounds which they have already charged. Is there any respite because of the immigration rule 34I? How they are going to consider application which were send before 6th April but recieved after that?

Just send the duly filled new form and difference of fee quoting the reference number and also a copy of letter received from HO. Hope everything will be ok.

It would cause lot of grief for you Unless you act immediately and withdraw your application especially f your visa has expired or going to expire in few days. The backbone of whole process is correct fee. If you they have charged wrong fee, you will get immeidate rejection (not refusal) .

When you re-apply,If your visa has expired, auotmatic extesion doesn't kick in and you can't work not to mention ILR issues. Simple mistake but huge problems.

Ideally you should have opted for same day service. Rathern wasting time on the phone in trying get an premium service appointment, there are plenty of companies who have been allocated regular slots with HO charge £100 to 200 extra to get the job done. It is quick and clean process.

If you send fax request for withdrawal, they will send your documents you will lose your fee but no rejection. But if you wait, it will take few weeks to hear from them and you may get your fee back but chances are you won't able to work.

JR decision is not relevant to your application because you have applied for an extension. It is always complex if you let your visa expire.

please bear in mind payments processing is done by third party firm and they got no links with caseworking team. The third party firm wil charge the amount you have chosen and signed as they are authorised only to charge that amount. Paying the difference won't work in most cases.
