Great news that the HSMP prior to 3rd April have a chance to get the ILR backdated.
In this instance where the HSMP application was refused b/c of orginal degree not available in mar 06 and then reapplied with original degree and approval recieved for HSMP 04 may 2006 with visa stamped on 05 sep 2006.
I can clearly see that with the above scenario i did not get HSMP prior to 3rd april so don't qualify for the judgement but wanted to put the circumstances out there for the experts to confirm please.

You might not be qualified for 4 years period, but you've also benefited from this JR that has granted you a qualified period of 5 years for ILR.

So the qualification was more than 5 years before the pre 3 april 06 hsmp holders judgement.
I have been on work permit since 28 May 2004
Got my HSMP approval on 4 may 2006
HSMP stamped on 05 Sep 06.
But the validity of HSMP was till 05 Sep 08 as at that time the eligibility for ILR was 4 years, which would mean ILR eligibility on 27 May 2008.
But the rules changed from 4 to 5 years after the HSMP issuance ;i had to recently apply for an HSMP extension.
So currently eligible for ILR 27 May 09 or 28 days rule after 1st may 09.
Welcome guidance/advice on the above specific scenario.

you just missed the 3 april date (unless you applied before then and it took over a month to get approval?). but you are still eligible for ILR on 1/5/2009. good luck.

Is their a way to validate from the home office of the date they received the application ?
Does the earlier refusal for HSMP in mar 06 for not having an original degree have any bearing on my standing for the eligibilty for ILR in 4 years?
After i got the degree i reapplied with success.
