Refusal - Error From Eco - What To Do Next?

Post by habx » Mon Apr 27, 2009 6:38 am

Hi guys

My Tier-1 got refused and the reason given that the institute where I studied at in 2002 is not a "recognised educational establishment". I think its an error and it has been made because the institute has changed its name and is listed in the UKBA Tier-4 list of recognised institutes. The ECO definitely made an error in evaluating my application and awarding me the points for education.

What do I do now? I have Limited Right to Appeal and I can request one administrative review. Its a clear, black and white case.

Anyone been through this? Any ideas?? HELP!

1) Yes my degree does appear in the Points Calculator.
2) I checked the new name of my college under the "Tier-4 Register of Sponsors" and its mentioned with an "A" Rating.

The link to the Tier-4 Register of Sponsors is
http://www.ukba.homeoffice.gov.uk/sitec ... seducation

Any more ideas and views?

I think ECOs are just as confused as everyone else by some of the tier requirements.

If you're absolutely sure that your college is the same, simply send the documentary evidence pointing out that the college has A listing as an approved sponsor and request an Administrative Review. If the ECM finds that the ECO has made an error, he or she will overturn the decision and grant you permission.

(Note that sometimes the refusal is valid, but the incorrect reasons have been given. In which case they'll just re-issue the refusal with new reasons.. :( )
Oh, the drama...!
