Advertising requirements for Sponsorship Licence application

Hi again

I have yet another question! Does the company need to advertise the vacancy before applying for the Sponsorship Licence even though I am switching from PSW to Tier 2 (General)? My company doesn’t have Sponsorship Licence but they have accepted to apply for it however I was told by the HR admin that previously when they applied for the Sponsorship Licence they were asked by the HO to go through the advertisement process first. I was under the impression since I am switching from PSW to Tier 2 (General) no advertisement or resident labour market test is necessary and I’ll be awarded 30 points automatically. Please also note that I have worked for the same company doing the same job for more than six months now .
Any clarification is appreciated.

Thanks Yasa, I thought so! She said they applied for WP for another person who had IGS last year and were told they need to advertise. I have given them all the rules regarding switching from PSW (or others such as IGS...) which clearly says 6 moths+ same job and same company 30 points awarded. She has not replied back yet so hopefully she knows the rules that apply to my case. I just wanted to double check. (Very stressful job when it comes to explaining these rules to them)
