how to write a witness statement?

how to write a witness statement?

Hi,

Can someone please guide me how can I write withness statement. What needs to be included in it. If someone can post a format fo rit it will be really helpful.

What is witness statement? Why do you need it?

I have a hearing in a month time and they asked me to send the bundel for the judge and a witness statement. I have no idea what is that and how can I right a good statement?

Can you please eloborate your case? What is this hearing for? What statement do you need from witness? What bundle you are talking about?

With very little background info provided by you, it will be difficult for forumites to comment on it.

I am sorry..Let me start form the beginning.

My application is an in-country applciation. I applied for the HSMp and been refused because soem of ht ebank statement got missing during the post and they were unbale to veify the previous earning.

Now I have applied for the appeal and they have given me a hearing date and asked me to submit a bundle of documents for the judge and the statement of witness. As no case worker is handling my case and I am doing it by myself. I have no idea what is witness statement .

I hope it will explaint he whole picture.

The best would be sending messages to the people who have applied for appeals.. You should be able to find many frm these forums..

This make sense. So your visa approval request/application was turned down because HO couldn't verify the details of your salary (or maintenance funds) from the bank statement as your bank statements were missing from original application.

Now the question is:

1. How can only some bank statement can get lost and not other? Did you provided all the required documents? HO maintain a copy of your documents which you have submitted with your application. If you bank statement was not received by HO (as a part of your application), HO can reject the application as for them it is simply a case of not providing sufficient corroborated evidence.

2. If you have provided Bank statement, and it went missing at HO (due to some mishandling at HO side), then you can successfully appeal against the decision.

I think in either case you would need professional legal advice. HO may ask you to prove that you have sent all bank statements and what you are saaying is true. Thats probably the reason, you are asked for witness etc(not sure if it is teh case in standard appeal process).

I did discuss the case with the case work and did get the legal advice but not doing the case through a legal advisor.

I didn't make the photocopies of my application that I sent to the HO. Is it going to be the problem to prove that I am right and I did provide them with all the documents?

You took legal advise on this from somebody. What did your legal advisor said?

He said its not going to be a problem it all depend on the judge what he decides to do.

So hoping for the best. As there is no reason why I shouldn't send the bank satatement.

I am not sure whether soemone else got the same problem or not.

If you are appealing in UK, better apply through lawyer. I think HO will send its lawyer and you on your own may not stand a chance in front of professionally trained lawyer. If lawyer thinks he can win the appeal better apply through him only. This is entirely my opinion.
