IGS to PSW got rejection(no right of appeal and visa expired

IGS to PSW got rejection(no right of appeal and visa expired

I have just got visa rejection (IGS to PSW), as there were some financial evidence missing.
However, I did actually got above 800 for each days of this period.
And I have no right of appeal against this decision. And the passport hasnt been returned to me. but I have the option to make new application.
But my visa expired since 1 feb 09.

Please note my IGS visa has been expired already since 1 Feb 09

On 26-Jan.-2009, I sent out my first transitional arrangement to PSW application but returned on 24-Feb.-2009 because of using incorrect PSW application form submitted and therefore returned my payment GBP400 as well. On 24/2 letter, HO only mentioned incorrect application form I’m using, they didn’t mention any appeal issue at that day.

I have been advised that my delayed second application caused the result of no right of appeal.
However, they didnt state any appeal issue at the time when they returned my first application and lead me to do the second application late without telling me the consequence of no right of appeal.

Would it be an argument?

My concern is that I am now overstaying here and have no right of appeal.
Can I still make an new applications? And why dont I have the right of appeal?

On 7 February 2008 I was granted to leave to remain in the UK as a participant of International Graduate Scheme until 01 February 2009 (expired). However, as the latest bank statement that I submitted was dated 26 Feb 2009 my statements need to show a consistent balance of at least 800 from 27 Nov 08. The statements that I have provided cover the periods 23 Oct 08 to 01 Dec 08 and 16 Jan 09 to 26 Feb, but do not cover a consecutive three month period. Therefore, I understood neither no administration view nor appeal right according to HO confirmation. Can you help to suggest whether I can submit missed period to witness daily 800 pounds at such situation ?

In addition, I’m advised to have the option to submit a fresh application with new or additional information not included in the application that is the subject of this decision. I received HO reject letter confirmation until 5/5, it became I’m illegal to stay in UK even passport was transferred to Local Enforcement Office. How to make fresh application right now inside UK (PSW or Tier 1 General)?

Can anyone give me some advice regarding my case.

Have you been to any solicitor?

HO has passed on your passport to UK Border team? If so, you could expect knock knock any time on your door so be carefull.
Arrived UK in Dec 2000, Received ILR Oct 2008, Citizenship Approved March 2016.

Sorry mate but you are in a very bad situation. It shouldn't have happened at the fisrt place if you would have sent the right application form. If they haven't returned your passports then you are definatly overstaying. Get in touch with a good solicitor and Pray to GOD.

If you have overstayed in this country then you would get a Ban for 1 year under any category, so be carefull and contact a solicitor.
