3 Questions-Marrying EEA National

Post by Gabriella2305 » Wed May 13, 2009 2:48 pm

Hello Everyone,

I have two questions to ask- I am a South African currently on a student visa which expires in December 2009. My fiance has an Irish Passport. We were granted our Certificate of Approval last month and have to register our intention to marry before the 8th July.

1st Question: Could we register to marry sometime in December? Or would that be leaving it too late to apply for the EEA2-I read on the home office site that you can get apply for the EEA2 at any time during your lawful stay in the UK, so as long as I applied before End of December I should be ok?

2nd Question: With my student visa expiring and sending our passports off-Would my fiance be able to send a copy of his passport as he is still able to travel. Also if he can send a copy what would he need to do to get it certified?

3rd Question: What happens when my student visa has expired and i need to travel after we get married whilst my EEA2 is pending, would I be able to? I'm thinking in case of an emergency or death in South Africa during next year, as I know this EEA2 takes ages to come back.
Would I be able to get back into the UK if i show our marriage certificate and letter you get from home office saying you have applied for an EEA2 along with my passport with expired student visa(i would also then send a copy of passport)

Any answers would help-thank you
