Hi
First of all - I apologize if I am posting in the wrong forum. Please move the topic to appropriate forum. I tried searching all the sections of this site but could not get a satisfactory answer and hence I am posting my case.
My family (Father, mother, sister (18+) and I (18+)), all Indian citizens, mother and sister dependent on father, applied for a Visitor visa to meet distant relatives (Family visa was not applicable) for a period of 7 days.
My father was sponsoring the trip for himself and the three of us. We submitted our application together and the processing agency told us to attach only the original financial documents of my father with his application. There was no need to attach photocopies of his documents with our application as our visas would be judged on his financial documents and everything was being sent together in the same pack.
After about 10 days, we received our documents back from the embassy with visas stamped on my Father, Mother and Sister's passports. However my visa was rejected.
In the refusal notice the following points were mentioned.
1. I did not submit any proof of my salary. The bank statement did not mention the salary credit as "Salary" hence the ECO could not find evidence of salary in bank statement
2. My father was sponsoring the trip in full, however the ECO could not find any financial documents to know my father's financial circumstances.
Hence they made a decision on my financial data only and concluded that I was not in a position to fund my trip and refused my visa.
Is this an overlook from the ECO because my father's financial documents were submitted in original with his application and I mentioned this in a sponsorship letter that I got from my father. Because neither my mother nor my sister got any notice. Their visas were approved. The refusal notice says I have limited right of appeal under Human rights and race discrimination sections of Immigration laws (which means practically I have no right of appeal).
The embassy here does not accept visa applications directly. They are routed through a commercial visa processing agency. I called up the embassy in Mumbai and they mentioned I had no right of appeal, refused to look into my case or hear my arguments, refused to give me a visa appointment to explain my case. They said I can re-apply if I wish.
Is there anything I can do except for reapplication? It would take 10 days for reapplication to be processed and we have to leave for UK next week.
Also is it possible that my application was rejected for some other reason but the financial document thing was mentioned in the refusal letter? Or is it just an oversight on the part of ECO who did not see my father's financial documents?
Your comments and feedback will be highly appreciated.
Regards
MS
