A8

Post by jannahjewel » Mon Aug 22, 2005 10:06 am

Hi, and I hope I have posted this in the correct place. I am working with a family who are from one of the A8 countries. Mr is working and Mrs isn't. Mrs is currently five month's pregnant, they have asked that I find out some information for them.

Firstly, when baby is born, will little he/she be able to apply for a British passport?

Secondly, although married, the couple have a different surname, and Mrs wants to change her surname now to her husband's surname. Would this be possible and if so how?

Thirdly, when (if ever) will Mr and Mrs be able to apply for British passports? They currently hold passports from their native Lithuania.

Many thanks, if anyone could help, or point me in the right direction, I'd be grateful.

I am looking for a more comprehensive answer as to whether the baby would be eligible for a British passport - the person who replied recommended this forum.

No. The child will not be a British Citizen and so is not entitled to a British Passport. However as a Lithuanian national (I presume by descent) the child is eligible to stay in the UK under EU law.
Secondly, although married, the couple have a different surname, and Mrs wants to change her surname now to her husband's surname. Would this be possible and if so how?
Marie B has advised on this.
Thirdly, when (if ever) will Mr and Mrs be able to apply for British passports? They currently hold passports from their native Lithuania.
When they acquire British Citizenship. Route to such is:

1. Apply for WRS permit (Mr. as he is working..has he done this yet?) = 12 months.
2. After 12 months on WRS apply for a full EU residence permit = 5 years.
3. After 4 years on full RP apply for ILR.
4. After 12 months on ILR apply for naturalisation as a British Citizen.

They have a five year wait as a minimum. Does that help?
