Hi,
I had obtained a Tier1 general visa in Mar2009. My current employer wants to send me to the UK on secondment and thus asking me to apply for work permit through them as they dont send anyone to UK on any other visa according to the company policy. Can you please advise, is it in anyway possible to retain my tier 1 visa intact and yet getting my company's work permit.

You can ask your company to send you on your current visa. As at any given time you can have only one valid visa on your passport, if you get WP done then your Tier 1 visa gets void.

I wouldn't accept this situation/condition from company. Your Tier 1 would be overwritten once you get WP. You company is pushing you to go for WP so as to retain you in UK. But once you loose Tier 1 you will be just a puppet in company's hands.

Good advice from the above two members. Just to add in here that the work permit rules have also now changed under the PBS and its now part of the Tier 2. Previously employers used to apply for the work permit but under the new rules, you have to apply yourself. The employer just have to issue you a letter of sponsorship and you have to pay all the fees etc yourself. So, if its you who has to do everything then why take the hassle for something that bounds you with one employer? You are better off staying on Tier 1. Tell your employer that in order for you to accept their offer they have to change their 'policy' and let you work for them on Tier 1 visa. Good luck.

Try to convince your employer that you are not looking for a change and will not leave the company. The major risk your employer faces is of you leaving them once in UK which could make them loose their face in front of their client.Try to convince your employer that you are not planning to leave them but at the same time also maintain position that you will not be overwriting your Tier 1.

Thanks everyone for ur valuable inputs. I have arrived in UK after my manager's insistance to which my company's HR agreed to allow me here for 2 months and meanwhile asked us to either get me a WP or get my replacement. So upto me now to try and convince that I wont be changing job here (which I believe does not need any extra support looking at the job market ) and try to forge myself here in current project and take things from then and there. Anyways good to be back to UK and save myself from burning sun back home :D although I do feel about those who are there :(

I tried to enquire about this on the internet but could not find anything about the possibility of changing Tier1 visa to Tier2. My actual problem is given on top of this thread. If this change is not allowed the it would be beneficial for me ( and thats what I am hoping for )or else I will have to take the decision (about changing the visa). Thanks in advance.
