travel query/ change of visa

Post by joy_kavee » Mon Jun 01, 2009 3:57 am

hi

my wife is on a student visa valid till oct 2010. I am her dependant. In January 2009, we travelled back home and we applied for tier 1 general. This time, i am the main applicant for tier 1 and she is my dependant under tier 1. Since the decision making process was taking a while, we travelled back to uk and our tier 1 application was still being analysed back home. Weeks later, i was contacted by phone and email, saying that our application is successful and that we have 6 months from date of application to come and have the visa.
So , this week, we have decided to go and take the visa back home.
Questions now..

Since the stamp is called an entry clearance, can we be refused entry?

As we already have student and dependant visa valid till 2010 oct, and now having tier 1 on the same passport, creating an overlap( which we don't mind).. will this create any problem whilst coming back? especially there has been a reversal of status.

Even if you have been awarded tier1 general, do you need to show any specific documentation when you enter uk?

thanks

No you will not be refused entry.

Your student visa is overwritten by tier1. So all you have now is Tier 1 visa based on which you can travel to UK. There is no overlap. You can only have one visa at one time. You cannot have two overlapping visas.

Since you are entering UK first time after EC is granted, I would prefer(as a backup though I think it won't be necessary) to take recent chest X-ray etc with you. Sometime immigration officers to like to see it. But chances are less if you land during busy hours/days e.g. weekends etc.
