!!!!!!INTERVIEW (APPEAL)!!!!!!!!!

Post by prettypolitical » Wed Jun 03, 2009 11:28 pm

Does anyone know or had experience of the following.

My husband's settlement application is currently under the appeal process and has been sent back to post for review.

What I would like to know or hear about; is it possible for post to call the applicant for an interview at this stage or not.

Any personal experience or advice would be really appreciated.

No.

It will now be decided by the review carried out by the ECM where your hubby was refused.

If he does not overturn the earlier decision,it will go to an oral appeal hearing here in the UK, whereby you or your legal advisor have to argue your case in front of an independent adjudicator.

Thanks, Batleykhan.

A much appreciated response, I thought as much, AIT have advised that all parties are to file before middle of September (they have specified a date), do they normally advised you of the decision made at post.

The thing that confuses me is that there is no deadline for them to give and answer, although there is a date for them to file their evidence if they will not overturn their decision, will they leave it right up until September to say yes or no!

Have you any idea or experience????

Can take up to 2 months

If he does not overturn the earlier decision,it will go to an oral appeal hearing here in the UK, whereby you or your legal advisor have to argue your case in front of an independent adjudicator.
The whole appeal procedure will take about 6 months to be heard. If you are lucky and win, it will take a further 3 months before your husband will eventually get the visa stamped in his passport

This whole facade is enough to get anyone down and depressed.Keep your chin up and you will eventually suceed.

Thanks Batleykhan for your positive response!

I appreciate your advice, I just wish there was something which could speed the process up, I am finding the situation very stressful and my three kids do not understand what is happening!

I am trying to hold a job down and look after three kids. its a farce!
