Help!! Late re-application tier1 switching from hsmp

Help!! Late re-application tier1 switching from hsmp

I got my application form returned due to errors and resent it next day. By the time it was sent back to me, d visa has expired for two weeks. The 1st application was sent about one month b4 my hsmp visa expired.
pls forum members have you got similar experience?, what should i do or expect?....i am really confused and worried...pls help!!!

Do you receive any letter from HO regarding this? If yes, can you mention what is written on it? Did it say that you will be considered under new rule or old rule?

If you qualify in new rules, then all you have to do is reapply with correct forms/details. Mention your circumstance in your cover letter and also include any correspondence from HO (of your returned application) with your new application. If should be fine.

Thanks for your response and the comments provided.
The form was returned with letter saying it was invalid due to rule 34A HC395 for not filling mandatory sections.....
It went further that...your fees will be returned within 28days
Lastly it said that the ...''submission of new application ie one in which d highlighted errors were corrected and on the correct form does not guarantee it will be successful but it will be considered in line with existing rules and policies.''
I filled in a new form, corrected the omissions in d 1st form and sent both back with covering letter as you stated.
Any further clarifications/advice will be useful pls!!!

nwa19,

If you do not have any issues with the rules in place after April 2009 i.e. of you qualify under new rules, all you need to do is complete the new form and send it for processing. Mention the details of this returned application in cover letter and also in the form. I think you should be fine.
I think this re-apply(with new/completed form) will be considered as new application and so you might need to qualify under new rules. But this is what I think from the highlighted section below.

thanks once again.
I very much meet the April 09 rules. my only concern/fear is if my re-application will be decided as out of date...ie an overstayer.

As i said you should be fine. Just reapply and explain the situation clearly in cover letter.

did they mention anything in our cover letter that you can apply within xx days like that ,as your visa is expired.

when is your visa expired?
You can legally stay in this country 28 days after your visa expired
