Spouse Visa... Mexican panicking!!! Please help!!

Post by Monyk » Wed Aug 31, 2005 6:54 pm

I am sorry I am posting again! But I need advice! I have read many of the posts here and even though they are very informative I can't help but to panic as there seems to be a lot of trouble when you apply for one of these things.

Well I am going to cut to the chase. I overstayed in the Uk for 5 months but while I was in the UK my passport ran out so I have a new passport which has no stamps on it but it says it was issued in London. this concerns me a lot because I am afraid that the ECO could refuse me the Visa because of that. The other thing is we have just a bit saved even though my husband has a full time job (We spent a lot of our savings in our wedding). And I want to know if based on your experiences you think this may represenbt a problem ( I mean we can support ourselves as he has a permanent job in a good company).

Please help! Advice me! I am very nervous about this! I don't want to have to live separated from my husband.

In the statistics says that last year there was none refused applications for visas in Mexico City (Settlement Visas). I can Imagine that there isn't many people applying from Mexico. But I just want more info.

Please help! Thank you for time.

Monica :(

Well Monica, the only way you are really going to find out if there is a problem is by applying!

Seriously, why should the place the passport was issued make any difference? You are obviously going to complete the form VAF2 accurately, so the fact that you overstayed your previous visa will be clear in any case ... even if the you had not needed to get a new passport.

Just go for it! And don't skimp on the supporting evidence .... and hopefully everything will be fine.

The thing is I have filled the VAF2 form and even though it asks if you have been in theUK before in doesn't asks further details.

I am guessing that the fact that I didn't overstayed for too long may be favorable ( At least thats what I am hoping!).

Thank you for asnwering me. I really appreaciate it this is a very stressful process over all emotionally.

one more thing. Once I won a competition for a Valentine's surprise for my husband and it appeared on the papers (of which I have a copy at home), do you think this could count as an evidence of the fact that our realtionship is genuine?

Thans for your time, anyway. I hope the best for everyone here.

Monica

Absolutely! Why not? If you have that press cutting available then certainly include it in your "evidence folder".

Hope it all works out.

Hi Monyk,

My husband successfully applied for his spouse visa earlier this year (in Tirana, Albania) and he had overstayed in this country for four years after falsely claiming asylum. The fact that you overstayed will not be an issue, so try not to worry.

Concentrate on putting together as much information as possible, especially relating to accommodation and finances. If your husband has a permanent job in a good company and you both have somewhere to live you should be fine. If you are worried you could write a statement as part of your documentation explaining that you have spent a lot of your savings on your wedding and that's why your bank balances are currently a bit low. The final section of the form asks for any extra information relating to your application - just write something like; see attached supporting documentation and written statement.

I would include the newspaper, its extra evidence that you are in a subsisting relationship.

Good Luck!

Thank you! I feel much calm now!

I am going to give it a go and see what happens. I am hoping that everything will be fine. I will let you know what happens.

Thank you very much for your advice.
