ILR for baby

Post by NewUser900 » Tue Jun 09, 2009 4:08 pm

I'm going to apply for ILR (HSMP holder), amd my 5-month old boy is one of the dependands. Only document we have for him - his Birth Certificate (he was born here). He don't have own passport and I didn't add him in my passport.
Does anyone know if my son can get ILR in this case?

I would recommend getting a passport for your baby before you go for ILR - thats the best solution

depending what your preference is with regards to your son having a british passport, you can seek to register him as a BC soon after you get ILR, he wont need to have ILR to apply for citizenship. If you would rather he got ILR instead then as ViperViper says you may have to delay your own application, this is this would be the best option with this regards. you can go ahead get your ILR and then apply for FLR for him when he gets his passport

The only reason I would go for a passport is to facilitate easy travel in case you have to travel with the baby, if you naturalise him/her and then apply for a british passport the whole process may take a cpl of months but given that your baby has gone without a passport for 5 months, maybe travel is not high on your list

Thank you very much for your responses! The only concern is when I booked an appointment for ILR I told them it will be 2 dependants. Would Home Office caseworkers mind if application will contain just one instead of two?
