Post by Mangogo » Thu Jun 11, 2009 7:01 pm

Hi
Pls help.
I want to apply for extension. But my husband have gone AWOL.
my current hsmp visa expires in 8 weeks. What do i do?
i am the primary applicant. can i get extension for my son in his absence.
My son was born here in UK. he is 9 moths old. i havec only done a year in UK.

Extension application under tier 1 ( previously on hsmp), how many years would i get?

Please respond soonest. time is running. thanks.

If you are primary applicant, you can apply for your extension. You can also get extension for your son too. You will be getting extension for 3 years under Tier 1.
I am not sure about your husband but you "might" have to explain where your husband is. I presume AWOL means "Absent WithOut Leave".

Thanks for fast response.
By AWOL. i mean he left/abandoned us.
i read on the ukba website that
"In order to be given entry clearance or permission to stay, a child must meet the conditions set out in the immigration rules at paragraph 319H of part 8,.
see link to details of 319H of part 8.
http://www.ukba.homeoffice.gov.uk/polic ... 1migrants/

Since my son's father is not available to apply with us, would they decline my son's aplication? Based on the condotions stated on 319H part 8?

I think you are talking about the following para for the 319H: but this looks like you can apply. Please wait for other members can add more inputs too.
(f) Both of the applicant's parents must either be lawfully present in the UK, or being granted entry clearance or leave to remain at the same time as the applicant, unless:

(i) The Relevant Points Based System Migrantis the applicant's sole surviving parent, or

(ii) The Relevant Points Based System Migrant parent has and has had sole responsibility for the applicant's upbringing, or

(iii) there are serious or compelling family or other considerations which would make it desirable not to refuse the application and suitable arrangements have been made in the UK for the applicant's care.
