Postal Application for PR

Post by WooHoo » Sun Jun 14, 2009 8:14 pm

Hello,

My wife is going to apply for ILR/PR soon, having stayed on a 2-year spouse visa.

On the price list it says postal applications are £200 cheaper but can take up to 6 months. Yet, she can only apply 28 days before her current visa expires. This doesn't seem to make any sense. What will she do if she is still waiting for a response after her visa has expired? Leave the UK?

Incidentally, does anyone else agree with me that the UK immigration system is insensitive, unclear, financially exploitative and a national disgrace?

yes i agree with you.

your wife will be on same status that she is now while her application is being decided.
she doesnt have to leave the country and her right as a spoue visa holder remains until a decision is made by ho.

hope that helps.

Many thanks for that.

Yes, indeed it does help. Lessens the cost a little.

The levying of charges against foreign immigrants is very cunning and sly. The foreigner often has very little choice than to pay it. The only way to appeal against this policy is for a significant proportion of the electorate to lobby the government. The Govt knows, however, that the British electorate are largely on the political Right on this issue. Devious, immoral and exploitative. (I hope they're reading this!!) :x

WooHoo, your wife will have so-called Section 3C protection. That is, as long as the application is made before the expiry of the old visa, that old visa will be "treated as continuing" until the application for a new visa is decided, even though its stated expiry date has passed.

The Section 3C protection will continue until the visa application is agreed and the new visa issued, or (and hopefully this is just theoretical for your wife) if the application is rejected, until the time for appealing against that rejection has expired. And as long as an appeal is made, the Section 3C protection will then continue until the appeal hearing, etc..
