Can a work permit holder change their visa status to be a dependant upon their partners tier 1 (general) visa, within UK?

Hi All,

I am a work permt holder and my wife is on tier - 1 (general) visa.

I now want to change my status to be dependant upon my wife's visa along with our newly born son. I phoned Home office and they said that I cannot change my visa within UK. I have to go back to India to get the visa changed and that I need an entry clearance again. The visa of my son can be obtained from within UK.

However, my visa is valid until june 2012 and my wife's visa is valid until april 2012.

Was the call centre operator confused or is there a rule that a work permit holder cannot change their visa to be dependant upon their partners visa?

The HO are right if you want to change from WP to T1G dependent...

The UKBA call centre is correct. You cannot change status from WP to T1 dependent from within UK. You will have to travel to your home country for the stamping...

You cant change to dependant with in the country ..

I guess, you can extend your visa based the marriage with in the uk, they use a form called FLR(M). But both of you have long term visa , extending visa doesnt make sense. but it frees you from sticking with the same employer ...you may get 2 years - probation ..afterwards ILR...having read many posts about people who had applied for a spouse visa abroad& waiting for long time , this might help changing the status with in the country...

seniors please comment if this is correct or not...
