wedding annicersary

Post by marley2005 » Thu Sep 15, 2005 9:41 pm

i did appeal for marriage visa refusal but as the days go on, i have only 20 days left for our wedding anniversary , my wife in the uk is asking me apply for a visitor visa at least we have this day together then i go back to algeria and reapply for marrige visa or wait for my appeal.

so is it possible to get visitor's visa , will they give me a chance to celebrate my wedding day anniversary wiht my wife at least a month or ten days

In your circumstances I would be amazed if you succeeded in getting a visitor's visa. Sorry!

Is your wife able to visit you in your country for the anniversary?

Any news about the appeal?

john,
thanks for the reply, well i did what you told me before and i sent a letter to the ECM i did get no answer then i sent my appeal and after some days i contacted the embassy they said it has been sent to London, then i found a job with an amercan drilling company in algeria i earn good money wiht a work rotation of 4 weeks on and 4 weeks off, in both months i earn 1100pounds; as the months went by, my wedding anniversary is on the 28th of october, and my wife has kids who attend school now, she is not able to visit me, i am thinking to reapply for marriage visa especially as u know i have only financial hurdle to jump over, but she gave me the idea of applying for a visitor's visa to celebrate the wedding and i am in between, she felt like it is gonna take time if i apply for marriage visa she wanted only at least we celebrate this happy moment together, we are both suffering much really, if u have any advise please don't hesitate.

Adding on to John's comments, you are certainly able to apply to visit your wife as a FAMILY VISITOR, and refusals of these applications attract the right of appeal. On the downside, if you are granted an entry clearance, it stands in UK law that your appeal has been abandonned...

hey marley.

my advice would be that your wife should go to algeria for few days, and join you to fix the problem with visa section...

it is well known that many people get refused marriage visas usually because the immigration officers put doubts on the authanticity of the marriage itself.

by approching the embassy along with your wife, this doubt will be obviousely lifted.

in my knowledge, many people got there visas as soon as there wifes/husbands goes with them to the british consulate. in your case it would be very sensible to arrange this with your wife, rather than try and ask for a tourist visa.

i am unsure if you are elligible to apply anyway for a visit visa at the british consulate in Said hamdine, or the hilton Hotel, Or if you actually have to travel to tunis to attend an interview..

either ways, i would STRONGLY recomand that your wife travels to algiers and re-apply with you.

i understand that your wife's kids started school etc.. but if your wife could travel for 4days, it would be more than ennough.

one more advice, i know that money can be a problem sometime, for this reason i'm advising you to get your wife an Air Algerie ticket instead of a british airways one, the price for a return ticket is speacially low "£250" but it has to be booked for "aid el Fitr" season. as air algerie do a special price. so you better hurry up.

wishing you all the luck.

dear jason,

thanks a lot for the precious advice,
well , at first i had student visa for one year, then a visitor's visa for six months, i never got a problem wiht immigration or overstayed my visa, that is why i am plannign to go to algiers and not tunisia.
for my spouse visa refusal i was refused only for one reason they say that i am not able to maintain myself wihtout recourse to public funds this means for me the financial hurdle i need to jump over, now i found a job wiht american drilling company, i work 28/28 this means every four weeks work i have four weeks vacation, i have a good salary i just wanted to gather all documents available and reapply but since i am not ready yet, and my wedding anniversary is closig up, i felt the need to ask for a visitor's visa; so i wo't miss the chance to celebrate it, on the other hand, when i come back it will show them clearly that i am not just a person who wants to get into the country.

marley,

1. Appreciate your situation and wanting to see your spouse. IMHO you would not obtain a visitor's visa. The money you would spend on this would better serve your spouse application.

2. In my heart, I agree with the suggestion that your spouse travel to Algeria/ Tunisia as the case may be subejct to a good deal/ package on offer perhaps through a charter company.

3. However in my head, given that refusal for spouse visa on funding, I would suggest you save the finances for either trip for the spouse visa.

4. There are other ways to show your communication to the ECO. Do you have a record of letters and phone calls?

5. Congratulations on the job anyway and I wish you all the best. I too work in the sector and we are facing many challenges as well as opportunities with commodity price swings.
