been in uk since 2006. April 08 before visa at time expired made a claim to the home office under the human rights act under the european convention of 1950 to stay in the country.
Got married to a uk citizen Oct 08 and applied for LTR Dec 08 and withdrew human rights application (under the advise of solicitor).
Have now received a notice with refusal of my marriage application and further been asked to leave the country and been refused right to appeal on the grounds that my LTR had expired at the time of my marriage application.
Am pregnant and due in august and dont want to go and give birth in zim.

so wat is my best option in proceeding with this case?? running out of time please help!!

Rutendo, do you have any other children? Also do UKBA know that you are expecting a child? Check your private messages.

i have a child back in zim. and no the ukba do not know am pregnant but i telephoned the enforcement office to let them know and they have given us till 15th June to come up with a new claim possibly asylum.

at the time of my application my solicitor told me he wld use the chikwamba case with our application but my faith in him has weakened, which i doubt he has done because from the response i got from the home office they have taken into consideration 1. the fact that i had a human rights case so i cld not travel back to zim when my visa expired. 2. they have made no reference to the chikwamba case.

terribly stressed!!!!!!!!!!

Rutendo, I think you can still go and apply for a spouse visa back in Zimbabwe. Meet the spouse visa requirements and it should not take long at all. I got my spouse visa after three days.

I overstayed 6 years and went back to Zimbabwe to get married to my husband who is a British citizen. We did take time to put all the required documents and had the help of the Immigration advisory service. The guy who was dealing with my case helped check the documents I was going to use in the application before I went home and also wrote a supporting letter for my application.

For a list of supporting documents we sent with the application see link below.
It was a bit over the top but we did not want to take any chances. All the documents were put together neatly in a very thick folder by the time we were done!

went and claimed asylum and i got 5 year discretionary leave. i have a child back in zim but now i hear i will not be able to bring her on my current status. is that true??
