Confused about 3rd party support...

Post by ccbergeron » Tue Jul 28, 2009 7:02 am

I am a British citizen, I married my Canadian husband in January.

I submitted the settlement visa paperwork at the Toronto Worldbridge office on July 6th.
I did include a letter from my mother saying we could have temp support from her before we found jobs.
We got an email last week saying:

-Evidence of more sufficient funds from you, your wife and your UK sponsor, your mother in law (e.g. recent bank statements).

I'm confused that if 3rd party support is not allowed, why are they asking for her bank statements?

Thanks.

I really hope someone can reply on this. Is temporary support allowed?

If it wasn't then why are they even still considering our application, they would have just said no straight away right?

They want to see my mum's bank statements, so I'm thinking we have a nice Entry Clearance Officer who wants to find a way to give us the visa, or I'm just very confused!

The rules don't allow financial support from a third party, but do allow things such as living with ones parents or in laws until such a time that you can support yourself by moving into rented accomadation or buying your own property.

What it doesn't allow is that if you or your husband dont have enough funds to support you, you cant ask family and friends to help you out.

Maybe he is feeling nice and generous to you and is looking at bending the rules slightly by checking that your mum does indeed have sufficient funds to support you by whatever means. It maybe that the ECO indeed believes that your chances of supporting yourself are so good that he will overlook the short temp support that you may recieve from your mum.

Maybe because you're Canadian and not Indian applying from Mumbai, where you would have recieved a clear NO answer

I thought 'bending the rules' would be out of the question. I really do have excellent job prospects when I return to the UK, and will be able to support my husband, and if it is the case that they can be nice to me then that's great, but I didn't think that happened with UKBA?

We faxed over all my mum's bank statements and investements totalling around £45,000, so it is obvious she can support us.

Do you think we have a good chance with this then?

Also we are only 23 and 22, so maybe they are being generous because we are so young?

Haha! I have to keep some sort of optimism or I maybe in fact have a nervous breakdown!

But on a serious note, about the 3rd party support, why have they asked for my mum's bank statements and is this a good sign?

Plus I sent in a ton of photos to try an get the sympathy vote lol. I know this isn't a joke by the way but like I said, if I didn't laugh I would def cry!

Well it seemed to have worked for you. Good on you.

I wonder whether this ECO could be given a free transfer to Mumbai or Islamabad, he'll be treated like a hero if he is that generous/ :D :D

I can't believe it's all over after all this time. Lesson learnt though.... it's always worth a try to include 3rd party support letter and bank statements because I'm pretty sure that's what tipped it for us.
I am the sponsor and I actually didn't send in any of my bank statements because I told them there is nothing in my account! So no point in sending it in!

Good luck everyone!
