Advice of best route forward

Good Morning

I have a very tricky problem and am looking for advice.

My girlfriend came to England on a Tier 1 Dependant Visa however is now looking to spilt up from her husband.

1) Does she have to leave the UK to apply for a Tier 1 or 2 visa?
2) Can she stay in the UK under the dependant visa if they are seperated not divorced? Been here for 3 years and married for 9 years
