citizenship of child born outside the country

Post by rogerroger » Sat Aug 08, 2009 12:27 pm

Hi,

If one's parents are british citizens by descent and the child is born outside of the UK, then the child is not entitled to british citizenship, is that correct?

however if the child is born in a country where he/she can not acquire the citizenship by birth, then would the child not be left without any citizenship?

No you are wrong. The child is British by descent.

U sure Babble?
In exceptional cases, the Home Secretary may register a child of parents who are British by descent as a British citizen under discretionary provisions, for example if the child is stateless.
Otherwise I think the Child wouldn't be British.

This is the problem, with the UK's two tier citizenship (first and second).

I think the Secretary of state can use discretion and register a child, if he/she doesn't meet section 3(2) or (5) requirements for registration

The Irish would allow such children to become Irish immediately, provided they are registered by their parents before they turn 18 years of age.

That is more ethical.

There are two ways the child can be registered which are listed below.

<< Section 3 (2) Registration>>

<<Section 3 (5) Registration>>

The good thing is that a citizenship obtained through these registration can be passed on.

thanks for the replies,

so if the child is being rendered stateless, then the child can acquire british citizenship through the discretionary powers of the secretary of state, correct?
