Work Permit holder to Tier 1 dependent

Work Permit holder to Tier 1 dependent

Hi,
My husband has his own work permit and has been working in the UK for less than 1 year. I moved to the UK on the new rules of HSMP Tier 1 in General category.

My question is can my husband switch from his Work permit visa into my Tier 1 visa as a dependent ?

Can he apply for a tier 1 dependent visa from within the UK ? or should he go back to home country ?

Please clarify if you have an idea.

as for as i think he will have to go back to home country to make a dependent application.

I agree with you. I think you husband have to go back to apply as a dependent.

Ur husband doesnt have to go back. If you have a job there and produce following evidences :
1) Marriage Cert
2) Proof of emp
3) Proof of Salary
4) Proof of Acc
5) Maintenance of funds (1600 + 2800) if you have been in UK for less than 1 year

Then ur husband can apply from there itseld.

Even I was in the same situation but I couldnt do it cus of maintenance of funds. But u can certianly switch from WP to Dependant route from within UK.

Hello krisbal,

My husband is in similar situation wanting to switch from work permit to Tier 1 dependant. R u sure in saying that he can switch within UK?
i have been in UK for nearly 2 years. first in work permit dependant visa and in Tier 1 general for the past 5 months. do you have any idea how much will be the maintenance fund for my husband?

Yes I have read in UK visa site. U cant switch from a dependant visa to Tier 1 visa. But u can switch from WP to Tier 1 dependant provided the main applicant is a Tier 1 holder.

krisbal please read the notes you linked to very carefully :). you can only switch into dependant category if:

You can apply for permission to stay here as the dependant of a highly skilled worker without having to leave the United Kingdom and apply for entry clearance if your last grant of entry clearance or permission to stay here was as the partner or child of:

an innovator;
a participant in the Fresh Talent: Working in Scotland Scheme;
a participant in the International Graduates Scheme (or the previous Science and Engineering Graduates Scheme);
a postgraduate doctor or dentist,
a student;
a student nurse;
a student re-sitting an examination;
a student writing up a thesis; or
a work permit holder.


So if anyone is in a similar situation to Sashi then the dependant will have to go back and apply from the country they originate from.

you are on hsmp and your husband(partner)is on wp...it should allow you to switch ...

it means only those who came as a dependent (partner or child) of someone under the listed categories can switch to that category
