children from 1st marriage allowed to come to uk?

Post by amserve » Sun Aug 09, 2009 9:18 pm

Is it possible for somebody to apply for his children (under 18 ) from his first marriage to come to the UK?

Assuming the first wife will stay abroad, and the second wife being in the uk.

What would the procedure be ?

Why would you want to take a one year old child from his/her mother. That is a gross violation of Article 8 of the Human Right law.

Perhaps you should consider bringing mother and child over.

Have you got full custody over the child, is the mother a danger to the child's life or well being.

If the answer to the two questions above is in the negative, i don't think any ECO in their right frame of mind will grant the visa, or any responsible authority will allow that child to be removed from his/her biological mother.

Do you have sole responsibility?

Is this one one of those polygamous marriages? How very 5th Century, I really can't believe this stuff is allowed to go on...

It should have said children under 18, not 1 ! silly smilie!!

Anyway, in such circumstances, does it simply come down to sole responsibility, or the fact that these kids have a father who is a british citizen have any favourable bearing ?

The question is whether or not you have parental responsibility and can prove it, and whether or not the mother will be willing to let the child come over and support the application .

You will need to prove to the ECO that you have been providing support to the child or that the child has been living with your family.

If you are able to provide all the above beyond reasonable doubt, i think you might be fine.
