Appeal allowed but couple of questions to clarify.

Post by najum31 » Fri Aug 21, 2009 4:31 pm

Hello to all members,

I'm new to this forum.....

I was refused for Tier 1 G in country application couple of months back and was given the right to appeal.

I appealed and last week on hearing, judge told me that he is allowing my appeal and will send me detailed decision later in post.

I still haven't recieved any letter from him(AIT).

Just have got two questions if anyone can kindly answer them.

1:Is it possible that judge might change his mind later on even though he told me on hearing day that he is allowing my appeal?

2:I know HO can appeal against the decision with in five working days after recieving the determination but can HO still refuse the application on any new/different grounds from the original one?

please answer them if anyone can...

Thanks

its usually the case that judges tend to change their mind after the hearing NOT!!

They dont have the authority to do so. So dont worry.

RE: HO doesnt really appeal on decision unless they are precedence setting cases. Not to worry again.

Congrats and have a nice weekend.

Thanks for reply!

Did you refere to HO that they can't bring froward anyother ground for refusal apart from original one which obviously has been dealt in my case?
