FALL IN SALARY !!

FALL IN SALARY !!

Hi All,

First of all thanks to all the senior members who have greatly contributed to the success of this website. This place is a great resource for all our visa related queries.

I have a unique problem and would greatly appreciate if you guys can help me. I am on my WHM visa and have been working from September 2007 till recently. I know that in order to qualify under TIER one pts based system I would require to earn minimum £23000 in last 12mths In the last seven months I have worked 25 weeks and have made about 15000 but due to the recent credit crunch I have lost my job and now I have got a job outside London but it is paying me half of what I used to get. On calculating various scenarios, I understand that I should be able to make my £23000 if I work till the end of my visa.

My queries are:

1) Would the drop in my salary create a negative impression on my application or would the case worker just check whether I have actually earned a salary of £23000 or not?

2)As you guys would know that under new WHM rules we are only allowed work one year but could some one explain how HO calculates one year.

Do they catch 52 weeks of work and exclude the holiday week taken? Or
Do they catch 52*5 working days = 260 in total working days. Now this can create a problem for anyone working seven days a week or doing two jobs? Or Do they catch 12mths from the day you first started working including all the weeks you were away.

I have taken five weeks off during last seven months and was wondering whether I can work 5 weeks more after I finish my contract?

3)Should I work the whole twelve months of my visa or should I apply for my visa afer nine mths using pro-rata basis?

It does not matter that your salary is dropped or increased. You have to proof the total earnings that you are claiming.

The visa on your passport tell you. I understand (senior memeber correct me if i am wrong)

You can claim any earning for past 12 months of last 15 months. So if you go week by week, then you can claim 52 weeks...not 53. If you are paid on week holidays as bonus, this should be included in on of your pay slip.
If you were not working for some time, you cannot be given extra time.

I would suggest the following:

1. Phone Home Office hear what they say.
2. Speak to an agent who may want to submit your application on your behalve.

Is my problem something very unique that is nevered been queried before?

Has no one faced similar problem before?

It would be great if I get some more feedbacks from other senior guys.

It shouldn't have any negative impact at all.

12 calendar months, I presume.

The earnings should be made within any 12 consecutive months in last 15 month period.

Pro-rata extrapolation is not accepted by HO. If you meet earnings' points after working 9 months then use 9 month's earning otherwise work for 12 months and then apply[/quote]
